Een Amerikaans districtsgerechtshof (dat van het District of Columbia) heeft de regering Bush opgedragen vragen te beantwoorden over miljoenen e-mails die, volgens beweringen van het Executive Office van de president, op backup-tapes worden bewaard. De regering heeft vijf werkdagen de tijd om al lang gestelde vragen over de missende e-mails te beantwoorden. Wij hebben daar al eerder over bericht. Het Witte Huis stelt dat de missende e-mails, die naar alle waarschijnlijkheid zeer bewust zijn vernietigd, worden bewaard op backup-tapes, maar er is nog steeds geen enkel bewijs dat die tapes er ook werkelijk zijn. Het Executive Office van de president is al eerder door het gerechtshof opgedragen de betreffende backup-tapes te bewaren. Rechter John Facciola verhoogde de juridische druk op 8 januari door van het Executive Office antwoorden te eisen op vragen of de backups identificeerbaar zijn bij de periode waaruit ze stammen of de gegevens die ze bevatten, of de backup-tapes mails bevatten uit de periode 2003-2005 en of de missende e-mails ook werkelijk op die backup-tapes staan. Facciola gaf aan dat de informatie over de missende e-mails 'time sensitive' is aangezien 'stored copies are increasingly likely to be deleted or overridden with the passage of time'. De opdracht van de rechtbank is onderdeel van een complexe juridische strijd tussen het Witte Huis en het National Security Archive, een onafhankelijk onderzoeksinstituut en bibliotheek van de George Washington University, en het Citizens for Responsibility and Ethics in Washington (CREW ).

'To date, the White House has evaded answering questions about whether it permanently destroyed over five million e-mails about issues such as Hurricane Katrina, the firing of United States Attorneys and the exposure of Valerie Plame's identity as a CIA agent', zo zegt Meredith Fuchs, juridisch voorganger van het National Security Archive, in een verklaring. 'This order will force the Executive Office of the President to tell the public whether it really erased key records of the nation's history or whether it has made any effort to preserve the information'. Het Witte Huis geeft toe dat de e-mails vernietigd zijn en dat ze in 2002 het electronisch archiveringssysteem dat de regering Clinton had geinstalleerd buiten werking heeft gesteld. De Presidential Records Act eist dat alle mail van het Witte Huis wordt bewaard. In een verklaring van 16 april 2007 verklaarde de persfunctionaris van het Witte Huis Dana Perino: 'I'm not taking issue with [CREW's] conclusions at this point. But I also will tell you that the technical folks that we've spoken to in the preliminary discussions [indicated] that if there had been an inadvertent human error or a technical problem … it wouldn't have been intentional and … there are ways that we can try to gather those [e-mails] if need be'. Ze vervolgde met: 'I think there are backup tapes; there are different ways in order to go back and find e-mails'. Anne Weisman, juridisch raadsvrouw voor CREW stelde in september dat 'The White House has known for a number of years the e-mails were missing and refused to do anything about it. It appears they are trying to run out the clock. We've had no indication of cooperation from them'. De regering Bush houdt vol dat de archivering van het Executive Office van de president niet onderhevig is aan uitspraken van rechtbanken. 'Also, the Federal Records Act does not allow the far-reaching action the two private groups are demanding', zo zegt een woordvoerder van het Witte Huis. 'Facts are stubborn things and the facts here are clear: 5 million e-mails are missing and until now the White House has refused to disclose what happened and whether any backup copies of those e-mails still exist', zo gaat Weismann verder. 'Today’s order is a first step towards holding the White House accountable'. 'Judge Facciola is trying to get the White House to say whether the 5 million missing e-mails are completely gone or recoverable', zegt Fuchs. 'To date, the White House has refused to say anything about its efforts to restore and preserve the records. I hope this order will force them to give an accounting to the American public'.
